The Woodgate Tower Protest Group were seeking funds for a judicial review around the council's on the grounds of the late publication of the section 106 agreement. However they recently published this announcement:
I'm sad to say that, in the end, the appeal will not be filed at the court; the crowdfunder page for doing this ('Woodgate Tower take to the High Court') has been closed, and all pledges to it will be cancelled/refunded automatically by crowdfunder.
During the preparation of the Pre-Action Protocol letter the barrister came across some information meaning that the car-free ground 'would not be arguable', and so dropped it from the claim. That left the single ground of late publication of the Section 106 agreement. By the point that I had to commit to filing the claim at court, it was the barrister's view that the remaining ground would be a very challenging one to win on, despite the evidence we'd produced.
So it no longer had a reasonable chance of success. I must concede also that, despite raising £2,635 over the last three days (over £7k including the previous two fundraisers), I couldn't be sure that the fund would reach the point that I'd be safe from finding myself with a heap of costs to pay, despite the £10k Aarhus costs cap.
